NDAs and "Confidential" labels alone are not enough to protect trade secrets - Access logs and information management necessary to prove trade secrets.will be speaking at
To protect trade secrets and personal information, many companies develop privacy policies and information security policies, and implement measures such as access control, encryption of communications, employee training, management of subcontractors, and regular audits.
However, no matter how many countermeasures are put in place, it is impossible to completely prevent information leaks.
When a data breach occurs, it can lead to a dispute. In actual disputes, the key issues are who had access to the information and how that information was managed.
Furthermore, even if an NDA is signed and the documents are labeled "confidential," this does not necessarily mean that they are legally protected as "trade secrets" under the Unfair Competition Prevention Act.
Furthermore, information leaks are not always discovered immediately after they occur. In some cases, data may be taken by former employees or leaked via business partners or contractors, and only become apparent several months later.
If the necessary logs have disappeared by that point, it becomes difficult to investigate and prove "who accessed which information, when, and what actions were taken."
In this seminar, we will welcome Mr. Naoki Kurokawa, a lawyer and patent attorney who was in charge of revising the Unfair Competition Prevention Act and the Guidelines for Trade Secret Management at the Ministry of Economy, Trade and Industry. He will explain the requirements for information to be protected as a trade secret and the evidence necessary for investigation and proof after an information leak.
In the second half of the interview with our CEO, Hirai, we will discuss the types of logs that should be kept, such as viewing, downloading, permission changes, and IP addresses, as well as retention periods and points to note when using them as evidence.
It's important to note that simply having access logs doesn't automatically mean they constitute trade secrets. This seminar will provide a practical explanation of not only the effectiveness of logs but also their limitations.
