Seminar Outline
In practice, to transport goods by ship, it is necessary to conclude a contract for the carriage of goods by sea for each specific item, and to issue a bill of lading or sea waybill. These types of cases are explained in a separate course.
However, simply understanding transportation contracts does not mean that you understand maritime law and logistics law.
For example, major shippers (manufacturers, trading companies, etc.) enter into charter parties with shipping companies and transport large quantities of goods by renting out entire ships, so understanding charter parties is essential in the world of maritime and logistics. However, because British case law has a great influence and understanding maritime practice is necessary to understand legal theory, I think this is an area that is more difficult to study than contracts of carriage. It is basically handled by lawyers known as "maritime lawyers," and there are very few books on the subject.
(Although this is not a charter contract example) There have been cases where lawyers who are not maritime lawyers have handled maritime cases and lost due to legal malpractice, so I think that lawyers who are not maritime lawyers need to be extremely careful when handling maritime cases. Personally, I think it is safer to have a maritime lawyer handle the case together with someone who is not a maritime lawyer, but even in that case, I think it is good to have some basic knowledge.
This course is also open to lawyers, so please feel free to take advantage of it.
