The risk of trade secret leakage exists for companies of all industries and sizes. In particular, the risk of trade secrets being taken (leaked) by former employees is serious, as is the risk of trade secrets being brought in (inflow) by new employees. Former employees may be arrested and convicted for illegally taking trade secrets, but it is also a reality that the company to which the trade secrets were taken after their transfer may also be convicted. The number of arrests in 2025 is projected to be the highest since records began, and against the backdrop of a revitalized job market, this risk is becoming a concern for all companies.
